40. *Mr. Arif Mustafa Jatoi: Will the Minister for Law be pleased to state:-
What are the responsibilities, perks and privileges of a Parliamentary Secretary in the Sindh Assembly?
ANSWER
Syed Murad Ali Shah (Chief Minister), Minister for Law:
· As far the responsibility of the Parliamentary Secretary is concerned, the rule 7-A of the Sindh Government Rules of Business,1986 which is reproduced as under:-
“7-A. A Parliamentary Secretary for Department shall subject to any general or special order, issued by the Chief Minister in this behalf, deal with such Parliamentary affairs concerned that Department as may be entrusted to him by the Minister and perform such public relations and functions as may be entrusted to him by Minister;
Provided that a Parliamentary Secretary shall not be required to undertake any functions which may be entail any interference in the internal working or administration of a Department, Attached Department or a Regional Office.”
As regards the question regarding Perks and Privileges of Parliamentary Secretaries in the Sindh Assembly, the Parliamentary Secretaries are getting Salary, Allowances and Perks Privileges under the Sindh Parliamentary Secretaries (Salaries, Allowance and Privileges) Act, 1974 (Sindh Act No. XXIV of 1974).

(a) Is it a fact that the no Parliamentary Secretaries have been appointed despite several Departments being held by un-elected people;
(b) If answer to (a) above is affirmative, the reasons thereof?
ANSWER
Syed Murad Ali Shah (Chief Minister), Minister for Law:
It is informed that Chief Minister’s Secretariat is in process of appointing Parliamentary Secretaries as per provision of Law and under applicable Rules, Regulations, Perks & Privileges.
1138. *Ms. Adeeba Hassan: Will the Minister for Law be pleased to state:-
Number of staff currently working in criminal prosecution service wing along with number of staff required?
ANSWER
Syed Murad Ali Shah (Chief Minister), Minister for Law:
The Prosecution Service Wing is consisting upon various offices i.e. Office of the Prosecutor General Sindh, Director (MI&E) and 27 offices of District Public Prosecutors (One in each District).
The sanctioned strength of staff in aforementioned offices from BPS-01 to BPS-19 is 2,678. Against which, currently there are 1588 staff members are working whereas; the vacant position of the Prosecution Service is 1090. In addition to that 29 more posts of various categories would be required.
1531. *Dr. Seema Zia: Will the Minister for Law be pleased to state:-
How many prosecutors are appointed by the Sindh Government for the prisoners, what is their criteria of selection and appointed?
ANSWER
Syed Murad Ali Shah (Chief Minister), Minister for Law:
No prosecutor is appointed by the Sindh Government for the prisoners but the prosecutors of different categories viz BPS-17 to BPS-19 are being appointed on the recommendation of Sindh Public Service Commission and they are conducting the prosecution on behalf of the State and not for the prisoners.
It is further submitted that only private Advocates on state expenses are being appointed by the honorable concerned courts for representing those prisoners/ accused who are unable to engage their Advocates. Remunerations/ Fees for such Advocates are being paid by the Government of Sindh through Criminal Prosecution Services Department.
The purpose of the Prosecutors is to prosecute and not to defend. Moreover, legal aid for petty offences is also being provided by the Government.
