 (a)   Is it a fact that during the past seven years, the Anti-Encroachment Force registered 185 cases and sent 110  cases for trial and of these cases less than half were decided with land grabbers being convicted in only five cases ;

(b)   If answer to (a) above is affirmative, the reasons thereof?

 196 FIR cases were registered against Land grabbers during last 07 years.  All cases were sent up for trial in trial court.

Breakup is given below:

·         45 cases were declared as “A” class by the trail court due to the non-availability of names and proper Bio data of the accused persons.

·        O1 case was declared as “B” class by the trial court due to the false allegation made by the complainant.

·        27 cases were declared as “C” class by the trial court due to lack of evidence.

·         30 cases are still lying pending in the trial court.

·        119 cases were challaned.

·        77 cases were acquitted by the trial court.

Reasons

1.      Lack of evidence.

2.      Details not provided by complainant.

3.      Weak prosecution.

 Details of the government property encroached in Sukkur and Larkana during the last five years along with the action taken against the encroachers.

 1.      Total retrieval of encroached state land in Sukkur, during last five (05) years is33160.04 acres, 605 sq.  Yards 104,800 sq. feet.

2.      Total retrieval of encroached state land in Larkana, during last five (05) years is 5,536 acres, 39,000 sq. ft.

(a)      Is it a fact that funds and other relief goods distributed in district Tharparker during 01-07-2016 to 30-06-2018;

The funds and relief goods detailed below received from the Governemnt of Sindh have been distributed to the drought and accidental fire affactees and most deserving persons in District Tharparkar

(1)  287,382 and 287, 233(total 574,615) wheat bags (100 kg each) on 9th, 10th and 11th phases distributed to the 287,382 and 287,233 drought affected families free of cost from 01.07.2016 to 30.06.2018.

(2) 50,973 wheat bags (50 kg each) distributed to the female beneficiaries holding Benazir Income Support Programme (BISP) CARD from 18.5.2018 to 30.6.2018.

(3) A cheque No. 18760303 dated 28-09-2017 amounting to Rs.43,25,000/- on account of payment of compensation to the 173 accidental fire victim families at the scale of Rs.25,000/- each family belonging to village Udani Taluka Chahcaro District Tharparkar was received vide letter No.SOG.CMS/MISC/2017 dated 28th September, 2017 of the Section Officer (General) Chief Minister’s Secretariat Sindh, Karachi and the amount distributed through Assistant Commissioner, Chachro copies of letter dated 03-08-2017 of the Principal Secretary to Chief Minister Sindh and letter dated 28-09-2017 of the Section Officer (General) C.M’s Secretariat.

 It is informed that due to shortage of Sub-Registrars in BPS-14, the Sub-Registrar working in BPS-11 has been assigned the dual charge of the post of Sub-Registrar(BPS-14) as per provisions of Rule-9(4) of Sindh Civil Servants (Appointment, Promotion & Transfer)Rules, 1974 is reproduced herein below:-

[(4) -Where the transferring authority is of the opinion that any post whose incumbent has been transferred cannot be kept vacant, without being detrimental to the work he may order any officer under his control to hold the said post, in addition to his own duties, until a substitute is appointed or for a period of one month whichever is earlier].

Further in order to facilitate the Registering Public and in the larger interest of government work as well as on administrative grounds the above act has been done.

Project regarding regularization of villages in Sindh under Sindh Gothabad housing schemes?

 

ANSWER

 

MAKHDOOM MEHBOOB ZAMAN, MINISTER FOR REVENUE & RELIEF:

 The Sindh Gothabad Housing Scheme Act (SGAS) was introduced in February 1987, with an objective to provide institutional arrangement for undertaking regularization of the villages and confer propriety/ownership rights to the existing occupants as well as shelter-less persons in the rural areas of Sindh.

There are about 66, 923 human rural settlements out of this 36, 566 have been identify under the scheme as per standard definition of the village.

 

Historically, we have seen that no village side was ever reserved for planned which resulted in the Mashroom and un-planned growth of un-authorized villages on the state Land as well as on the private land under Sindh Gothabad Housing Scheme Act 1987, the Collectors/Deputy Commissioners are working independently and all the records are lying with them including Sanads Books, Challan Books and the all facts/details about the villages. Basically the Collector/Deputy Commissioners are sole responsible of the issuing the Sanads hearing the appeals issuing of sanction orders under the Act 1987, also after the regularization of villages the Deputy Commissioner/Collector shall issue Sanads as per approved list of occupancy.

The Member / Director (Gothabad) are only concerned with rural villages of Entire Sindh Province.

 

VILLAGES REGULARIZED BEFORE INTRODUCTION OF SINDH GOTHABAD (HOUSING SCHEME) RULES 2008.

Out of 36,566 villages identified in Sindh Province 12,912 villages were regularized leaving 23,654 to be regularized.

 VILLAGES REGULARIZED AFTER INTRODUCTION SINDH GOTHABAD RULES 2008 TILL 28-11-2012.

Unfortunately no rules were framed up to the year 2008, which were mandatory under section 12 of the Act, hence, the Government made Rules there under in the year 2008, which are applicable to date. It was decided that all such villages which are up to the mark and come into the ambit of this rule framed in 2008 shall be regularized.

 

After introduction of Sindh Gothabad Rules 2008, and constitution of survey committees and allotment committees and on their recommendations there are 1874, villages in rural areas surveyed through Topographical survey in Karachi Malir, West, Hyderabad and Thatta Districts from which 724, villages have been regularized and 1150 villages yet to be regularized and under process.

The above remaining number of villages of rural area is at the final stage of regularization and shall be regularized as per Government policy after lifting the ban, Imposed by Honourable Supreme Court of Pakistan vide judgment dated: 28-11-2012, where under the Honourable Supreme Court of Pakistan restrained on disposal of the any state land.

Due to non-availability of funds under the head of Topographical survey of villages, no survey is being conducted.
