QUESTIONS

    40.    A Member may ask a question for obtaining information on a matter of public concern within the special cognizance of the Minister to whom it is addressed.

    41.    Subject to these rules, the first hour of every sitting, after recitation from the Holy Quran and swearing in of Members, if any shall be available for the asking and answering of questions:

            Provided that if a sitting is held on a day other than the working day, there shall be no question hour.

    42.    Notice of not less than fifteen days shall be given for a question to be asked in the Assembly unless the Speaker, with the consent of the Minister concerned, allows it at shorter notice.

    43.    (1)    Question of short notice shall ordinarily be answered at the end of the question hour.

            (2)    Not more than one question of short notice shall be asked on one day.

            (3)    Question of short notice shall not be asked in anticipation of a question of which notice has already been given.

    44.    (1)    Notice of question shall be in writing, addressed to the Minister by his official designation, who is desired to reply it and shall be delivered to the Secretary.

            (2)    A question to which oral answer is desired shall be distinguished with an asterisk.

            (3)    If in the opinion of the Speaker, a question to which oral answer is desired, is of such a nature that written reply would be more appropriate, he may direct that such question be placed on the list of questions for written answers.

    45.    A question shall not be included in the list of questions for answer before expiry of ten days from the day when, after its admission by the Speaker, it is brought to the notice of the Minister.


    46.    (1)    Not more than five starred and five unstarred questions of the same Member shall be included in the List of Questions for one day.

            (2)    Questions shall be included in the List of Questions in the order in which the notice thereof are received.

            (3)    A Member may, by notice in writing, withdraw his question at any time before the sitting in which it is fixed for answer.

    47.    Different days may, by rotation, be allotted by the Speaker for answering questions relating to such department or departments as may be specified by him.

    48.    (1)    If any question included in the List of Questions for any day is not called within the time available for answering questions on that day, the answer shall be laid on the Table by the Minister concerned.

            (2)    If the Minister is not ready to answer any question addressed to him, that question shall be fixed for answer on the next day allotted for his department.

    49.    In order that a question may be admissible, it shall not-

            (1)    contain any name or statement unless it is necessary to make it intelligible;

            (2)    contain a statement which a Member does not believe to be true;

          (3)    contain arguments, inferences, ironical expressions imputations, epithets or defamatory statements;

            (4)    seek an expression of opinion on any matter or, solution of, legal problem or hypothetical proposition;

            (5)    refer to the character or conduct of any person except in his official or public capacity; nor shall it refer to the character or conduct which can be challenged only on a substantive motion;

            (6)    be of excessive length;.

            (7)    relate to a matter not being (primarily) concern of the Provincial Government;

            (8)    seek an information on any matter concerning bodies of persons not responsible to the provincial government except where the Provincial Government has financial interest in such bodies of persons;

            (9)    seek an information regarding any matter under consideration of a Committee of the Assembly or Proceedings of such Committee before the report of the Committee is placed before the Assembly;

             (10) contain direct or indirect charge of a personal character;

            (11)  raise a matter of policy too big to be answered;

            (12) repeat in substance a question already answered;

            (13) be trivial, vexatious, vague or meaningless;

         (14) seek an information contained in documents accessible to the public or ordinary works of reference;

        (15) contain references to newspapers by name nor shall ask whether statements in the Press or by private individuals or  non-official bodies are accurate;

       (16) seek an information regarding Cabinet discussion, advice given to Governor or any matter against disclosure of  which  there is constitutional or statutory bar.

      (17)  contain any reflection on the conduct of Governor or Judges of  Supreme  Court and High Court;

          (18) contain any criticism of a decision of the Assembly;

         (19)  seek information about any matter secret in nature;

        (20)  contain any reflection on a decision of a court of law or statutory tribunal established in Pakistan or a remark as is likely to prejudice a matter which is subjudice;

        (21) refer discourteously to a foreign country.

  50.    Questions relating to the Assembly may be asked by addressing a communication  to the Speaker.

  51.    Admissibility of a question shall be decided by the Speaker within five days of the receipt of its notice provided any question may be admitted subject to amendment in its form.

  52.    Questions admitted shall be entered in the List of Questions together with answers thereof received in the Assembly Secretariat not later than two days before the day on which they are fixed for answer.

  53.    (1)    On commencement of question hour, the Speaker shall call Members  one by one in the same order in which the starred questions stand in their names in the List of Questions unless such order is changed with the leave of the Assembly.

            (2)    A Member so called shall rise in his place and shall unless he declares his intention otherwise, ask the question standing in his name and by reference to its number in the List of Questions.

            (3)    If the Member in whose name the question stands is absent, the Speaker may at the request of any other Member direct that the answer to that question may be given.

  54.    When a starred question has been answered any Member may ask such supplementary questions as may be  necessary  for the elucidation of the answer, provided that the Speaker may disallow any supplementary question  which, in his opinion  is in-admissible under the rules.
