102.     *Mr. Arif Mustafa Jatoi:      Will the Minister for Law be pleased to state:-

(a)   Is it a fact that the automation of Law, Prosecution departments have not yielded any improvement in Department’s working;

(b)   If answer to (a) above is affirmative, terms and conditions for the same?

ANSWER

Mr. Ghanwar Ali Khan Isran, Parliamentary Secretary for Law & Parliamentary Affairs:

·       Automation of Law department has updated all Gazette Acts, Ordinances and Bills on website from the year 1827 to 2018, also translation of legislation is being updated on website. (www.sindhlaws.gov.pk).

 

·         Automation is working on CASE MANAGEMENT SYSTEM (CMS) for computerization of prosecution records on lowers courts. 50% Districts are working on it. By which District Offices can manage records online whereas, I.T staff is required at Districts level.

 

·         Team of Automation has developed mobile application of Law Department, which is available on android app store for public to get easy Access of gazette laws, rules and translated laws on their smart phones.

 

·         Automation is being hosting Document Management System Software QR-code to make authenticity & preservation of documents (Opinions summaries, orders letters etc.) Office record more safe and secure.

 

·         Automation is being hosting E- Medical Reimbursement System computerized process of medical bills including all attached departments high court and ATC courts.

·         Automation is being hosting E-HRM software for computerize the record of all employees of this department. 

·         Automation team is managing their server room for hosting of all software.

 

Also Automation team has represented their work at Supreme Court of Pakistan and got appreciation certificate for Sindh.

(a)   Is it a fact that Students domiciled outside Karachi are admitted in limited number in S.M Law College;

(b)   If answer to (a) above is affirmative, number of Students admitted since 01-01-2018 to-date along with District of domicile?

ANSWER

The students in S.M Law College are admitted purely on merit basis and not on the domicile basis”.

(a)   Is it fact that a project of construction of two (02) Court Buildings at Shahdadkot @ Kambar with the cost of Rs.140.000 million is to be completed  by June 2020;

(b)   If answer to (a) above is affirmative, details of work completed and amount spent todate?

The scheme was approved at an estimated cost of Rs.141.064 Million, in March, 2018 and will be completed in 2020-21, details are as under;

·      Approved Cost Rs.141.064 (M)

·      Expenditure up to June, 2018 Rs.8.7350 (M)

·      Allocation for the year 2018-19 Rs.40.000 (M)

·      Funds Released during C.F.Y 2018-19 Rs.10.000 (M)

·      Expenditure during C.F.Y Rs.0.464 (M).

 

191.     *Ms. Nusrat Sehar Abbasi:  Will the Minister for Law be pleased to state:-

(a)   Is it a fact that a project of construction of record room adjacent to Judicial Complex Badin with the cost of Rs.7.000 million was to be completed by June 2018 but the same has yet not been completed;

(b)   If answer to (a) above is affirmative, the reasons thereof?

The scheme was approved at an estimated cost of Rs.6.721 Million, in October, 2017, only 1st quarter Rs.1.6802 (M) during the last F.Y 2017-18 and work is in progress, details are as under;

·         Approved Cost Rs.6.721 (M)

·         Expenditure up to June, 2018 Rs.1.6802 (M)

·         Allocation for the year 2018-19 Rs.5.041 (M)

·         Funds Released during C.F.Y 2018-19 Rs.0.000 (M)

·         Expenditure during C.F.Y Nil

 

192.     *Ms. Nusrat Sehar Abbasi:  Will the Minister for Law be pleased to state:-

(a)   Is it a fact that a project of construction of two (02) courts at Tangwani Kashmore with cost of Rs.55.000 million is to be completed by June 2019;

(b)   If answer to (a) above be in the affirmative, the current status of the same? 

ANSWER

The scheme was approved at an estimated cost of Rs.48.833 Million, in February, 2018 and will be completed in 2019-20, details are as under;

·         Approved Cost Rs.48.833 (M)

·         Expenditure up to June, 2018 Rs.3.4375 (M)

·         Allocation for the year 2018-19 Rs.45.396 (M)

·         Funds Released during C.F.Y 2018-19 Rs.11.3490 (M)

·         Expenditure during C.F.Y Rs.7.9950 (M)

 

2323.   *Mr. Khurrum Sher Zaman:           Will the Minister for Law be pleased to state:-

(a)    Is it a fact that salaries to special public prosecutors representing Rangers have not been paid since 2018;

(b)   If answer to (a) above is affirmative, the detail thereof?   

ANSWER

Mr. Ghanwar Ali Khan Isran, Parliamentary Secretary for Law & Parliamentary Affairs:

 It is not a fact.

The Special Public Prosecutors of Pakistan Rangers Sindh have been paid monthly salaries upto 31.10.2019. 

 

 

3775.   *Mr. Rabistan Khan:           Will the Minister for Law be pleased to state:-

District-wise number of Civil and criminal cases disposed off in High Court of Sindh during 2014-2018?

ANSWER

This is to inform you that no district-wise cases are instituted or disposed of in the High Court of Sindh either Civil or Criminal.

As informed by the High Court of Sindh, steps are taken regarding speedy justice in Civil and Family matters pursuant to decision / policy of National Judicial (Policy Making) Committee laid down in National Judicial Policy 2009.

The High Court of Sindh has informed that Banking suits are disposed of under sections 10 & 13 of the Financial Institution (Recovery of Finances) Ordinance, 2001 (Ordinance No.XLVI of 2001) which is a Federal Law.

 

4520.   *Mr. Muhammad Ali Aziz:  Will the Minister for Law be pleased to state:-

Detail of the legislation/polices/programs for the protection of the witnesses in the high profile cases during the tenure of last Assembly (2013-18)? 

ANSWER

Mr. Ghanwar Ali Khan Isran, Parliamentary Secretary for Law & Parliamentary Affairs:

The Sindh Witness Protection Act, 2013 was enacted and published on 1st November, 2013.

This law provides a complete and comprehensive witness protection programme, policy and all related protections of witness to enable them to give evidence in criminal proceedings in the Province of Sindh.

 

4683.   *Mr. Khurrum Sher Zaman:           Will the Minister for Law be pleased to state:-

(a)   Is it a fact that Government is intending to established consumer court in all 29 districts of the province;

(b)   If answer to (a) above is affirmative, the realistic timeline for the same?

ANSWER

Mr. Ghanwar Ali Khan Isran, Parliamentary Secretary for Law & Parliamentary Affairs:

a)         Yes, it is a fact.

 

b)        The twenty Nine (29) Consumer Protection Courts have already been established in Judicial/Revenue Districts of Sindh vide Notification No.SO(G)AS&PD/CPC/Accom/2017/25 dated 10.01.2019 issued by Agriculture, Supply & Price Department, Government of Sindh and Consumer Protection Court is presided over by a Civil Judge & Judicial Magistrate in respective district.

Since the Consumer Protection Courts are already functioning in the twenty nine (29) Districts in the Province of Sindh as stated above (reply to (a)) the question of realistic timeline does not arise.

 

6434.   *Mr. Kanwar Naveed Jamil:           Will the Minister for Law be pleased to state:-

(a)     Is it a fact that crores of rupees embezzlement committed in serving certificate deposited in perfect branches for surety bail in the courts of the province from 2015 to date;

(b)     If answer to (a) above is affirmative, detail there of? 

ANSWER

            It is not a fact. Therefore, the requisite information may be treated as NIL.

 

6435.   *Mr. Kanwar Naveed Jamil:           Will the Minister for Law be pleased to state:-

Number of Judicial officers of subordinate Courts of the province against whom action taken which were involved in embezzlement of serving certificates?

ANSWER

Mr. Ghanwar Ali Khan Isran, Parliamentary Secretary for Law & Parliamentary Affairs:

No case of embezzlement has been found so far. Therefore, the requisite information may be treated as NIL.
