 (a)   Is it fact that a scheme of construction of officers/officials residential accommodation for the Prosecutors in Sindh with the cost of Rs.359.161 million to be completed by June 2020;

(b)   If answer to (a) above be in the affirmative, detail of work completed and amount spend todate?

The scheme was approved on 27/8/2008 on old plinth area rates of 2004 at an estimated cost of Rs.359.161 Million Block. With completion plan period of three years but due to adequate funding and hike in the cost of construction material, labour charges, work could not be completed within original approved cost and scheme needs revision, revised rough cost estimate under preparation.

183.     *Ms. Nusrat Sehar Abbasi:    Will the Minister for Law be pleased to state:-

 (a)   Is it fact that a project of construction of 01 court building at Taluka Mehrabpur Nushero Feroze with the cost of Rs.32.998 Million is to be completed by June 2019;

(b)   If answer to (a) above is affirmative, detail of work completed and amount spent todate?

The scheme was approved at an estimated cost of Rs.32.998 Million, in September, 2016 and will be completed by June, 2020 as per Budget Book, details are as under;

·           Approved Cost Rs.32.998 (M)

·           Expenditure up to June, 2018 Rs.16.4990 (M)

·           Allocation for the year 2018-19 Rs.3.750 (M)

·           Funds Released during C.F.Y 2018-19 Rs.0.938 (M)

·           Expenditure during C.F.Y Nil.

 (a)   Is it fact that a project of construction of Car Parking/Conference Hall/ Offices/Courts in depression portion at district court Sukkur with cost of Rs.129.613 Million to be completed by June 2020;

(b)   If answer to (a) above is affirmative, detail of work completed and amount spent todate?

The scheme was approved at an estimated cost of Rs.129.6138 (M), in February, 2017 and will be completed by June, 2020. (Entire funds released within time), details are as under;

·      Approved Cost Rs.129.613 (M)

·      Expenditure up to June, 2018 Rs.5.000 (M)

·       Allocation for the year 2018-19 Rs.50.000 (M)

·       Funds Released during C.F.Y 2018-19 Rs.12.500 (M)

·       Expenditure during C.F.Y Rs.12.500 (M)

 409.     *Mr. Arsalan Taj Hussain:    Will the Minister for Law be pleased to state:-

 Number of civil, criminal, family or banking courts cases pending in terms along with efforts made in terms of any law or legislation that ensures the provision of speedy and affordable justice for people of Sindh?

ANSWER

Syed Murad Ali Shah (Chief Minister), Minister for Law:

There are 92,189 cases in High Court of Sindh and 101,059 cases in District Judiciary of Sindh are pending.

 

Out of above 37,090 of civil, 54,269 criminal, 14,125 family and 7,738 banking Court cases are lying pending in various Courts, Tribunals of the Province.

 

The remaining balance of various nature of cases is also pending in the superior and other courts.

 Access to justice is priority area of the provincial Government. In order to reduce work load and expenses in court system, Alternate Dispute Resolution (ADR) mechanism and measures such as mediation and conciliation are being considered through amendments particularly in section 89-A, Code of Civil Procedure (Act V of 1908) and Order X in 2002.

For strengthening the criminal justice system, Sindh Rule of Law Road Map, Project is under study. Review work by the stakeholders on the said Project is going on under the supervision of Home Department. Besides, prosecution services are being provided actively in all courts of the Province including Supreme Court of Pakistan with regard to fair, speedy and inexpensive justice to the common people of the Province.

 412.     *Mr. Arsalan Taj Hussain:    Will the Minister for Law be pleased to state:-

 The total number of complaints, against prosecution department along with efforts/ legislation made during last ten years, to upgrade and strengthen the department and office of prosecutor General, Sindh?

There is no complaint against the Prosecution Department. However, concerned Provincial and District level offices are dealing with redressal of complaints as per existing laws as and when received. The Sindh Criminal Prosecution Service was introduced in the Province in 2007 through an Ordinance. In 2009 an Act titled “The Sindh Criminal Prosecution Service (Constitution, Functions and Powers) Act, 2009 was enacted to give legal cover and to boost up prosecution services for public in the Province at gross root level. With the setup of prosecution services, the process of criminal cases in the courts has become speedy, fair and inexpensive. For the upgradation and strengthen of the office of Prosecutor General, Government of Sindh has taken efforts for increase the manpower from time to time, at present approximately 550 Prosecutors  are performing prosecution job in the Province.

 

For the furtherance of the skills of the these Law Officers, foreign and local trainings in collaboration of US Department of Justice and US Aid Program GIZ and Sindh Judicial Academy are being provided. Approximately 550 male/female Prosecutors have been trained in order to make their services more useful and effective for the common people. Measures have also been taken through ADP Schemes by initiating various development schemes (new/ongoing) for construction of office/residential accommodation for the Prosecutors.

 498.     *Mr. Khurram Sher Zaman: Will the Minister for Law be pleased to state:-

 (a)   Is it a fact that the department has taken or proposed measures to improve the prosecution services in the province;

(b)   If answer to (a) above is affirmative, the details thereof?

The Sindh Criminal Prosecution Service was introduced in the Province in 2007 through an Ordinance. In 2009 an Act titled “The Sindh Criminal Prosecution Service (Constitution, Functions and Powers) Act, 2009 was enacted to give legal cover and to boost up prosecution services for public in the Province at gross root level.

 

At present, the offices of Prosecutor General, Additional Prosecutor General, Deputy Prosecutors, Assistant Prosecutor General, District Prosecutors, Deputy District Prosecutors and Assistant District Prosecutors, are providing prosecution services to the general public at District level in the Province.

 

All lower courts within a district are attached with the office of District Public Prosecutor in distribution of cases / work assigned to them.

 With the setup of prosecution services in the Province, the process of criminal cases in the courts (lower to higher courts) has become speedy, fair and inexpensive. Government of Sindh intends to make more efficient prosecution services in the Province in order to provide facilities like more manpower, infrastructure, trainings and information technology facilities.

 501.     *Mr. Khurram Sher Zaman: Will the Minister for Law be pleased to state:-

 (a)    Is it  a fact that the measures are likely to be implemented to ensure that prosecutors turn out in Anti-Terrorism Courts;

(b)   If answer to (a) above is affirmative, the details thereof?

There are 33 Anti-Terrorism Courts established in the Province of Sindh, as per the following break-up:-

Recently 67 Assistant Prosecutors General (BPS-17) have been appointed by the Government on the recommendations of the Sindh Public Service Commission.

 

Their services are being utilized in the Anti-Terrorism Courts. Before the appointment of above Prosecutors, the Prosecution Services were being provided by Home Department and Prosecutor General jointly in the Anti-Terrorism Courts.

 

The appointment of new Prosecutors and their attachment with Anti-Terrorism Courts is a step ahead for the strengthening of criminal judicial system / prosecution in the Province in order to provide fair, speedy and inexpensive justice to the common people.
