If so, would the Minister explain why and on what grounds will this improve the Law & Order situation in the Province?

 242.     *Ms. Nusrat Sehar Abbasi:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 

(a)   Is it a fact that a project of  construction of boundary wall and other allied facilities at Dargha Saeedi Moosani district Dadu with cost of Rs. 43.008 million was to be completed by June 2018 ;

(b)   If answer to (a) above is affirmative, present position of the same?

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

The scheme “construction of boundary wall and other allied facilities at Dargah Saeedi Moosani ADP No.40” was approved with an estimated cost of Rs. 43.008 million the same is being executed by the Auqaf Department. The allocation of Rs. 4.000 Million kept in ADP 2018-19 and Rs. 2.000 (being 50%) released to Executing Agency the work of compound wall is completed while the works of Construction of Dispensary, Office, Musafirkhana, Lavatory Blocks are in completion stages, while as per plan and allocation the completion date is June, 2019, a total expenditure of     Rs. 39.000 (Million) has been made upto June, 2018.

243.     *Ms. Nusrat Sehar Abbasi:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 

(a)   Is it fact that a project of  construction of  dispensary/ minor and repairs attached unit at Dargha Lawari Sharif district Badin with the cost of Rs. 23.365 million was to be completed by June 2018

(b)   If answer to (a) above is affirmative, details of work completed to date?

ANSWER

 

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

The scheme “Construction of dispensary / minar and repairs attached units at Dargah Luwari Sharif District Badin ADP No. 58 (2017-18)” is being executed by the Auqaf Department with an approved cost of Rs. 22.500 million out of which an amount of Rs. 18.740 million were spent on the scheme and Rs. 4.000 million were left.

The work of construction of dispensary & repair of attached units has since be completed, while the work of construction of minar is at foundation level as the design of piles & pile cap have changed in the light of the report of soil test time period will be informed after the finalization of report.

     The scheme is under revision.

246.     *Ms. Nusrat Sehar Abbasi:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 

(a)   Is it a fact that a project of  construction of  District Sukkur repair and renovation at Markazi Jamia Masjid road Sukkur with cost of Rs. 15.000 million is to be completed by June, 2019;

(b)   If answer to (a) above is affirmative, details of work completed and amount spent to date?

 

ANSWER

 

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

The work of “Repair / Renovation of Markazi Jamia Masjid Bunder Road Sukkur ADP No. 45” is being executed by Auqaf Department with an estimated cost of Rs. 9.463 million a sum of Rs. 0.876 million was released during the financial year 2017-18 for the scheme and an allocation of Rs. 8.587 million has been kept in the financial year 2018-19 and released by Finance Department.

 

 

The work of plaster, electrification & colour is done while marble flooring & Minor repair work is remaining. Completion date of the scheme will be June 2019.

 451.     *Mr. Arsalan Taj Hussain:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 The accountability & report back mechanism to maintain the transparency in Zakat distribution.

ANSWER

 

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

Assistance to the needy, the indigent and the poor particularly, orphans, widows, the handicapped and the disabled persons is extended through cross cheques / order cheques or Auto Teller Machine (ATM) in term of Section-9 (3) of Sindh Zakat & Ushr Act, 2011 and Sindh Zakat Disbursement Procedure approved by Sindh Zakat Council to maintain transparency.

It is mandatory requirement under Section-11 of Sindh Zakat & Ushr Act, 2011, the Auditor General shall conduct annual audit of the Sindh Zakat Fund, District Zakat Fund and Local Zakat Fund including the accounts of a Deducting Agency or an institution receiving Zakat.

452.     *Mr. Arsalan Taj Hussain:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 

Distribution mechanism for the zakat fund alongwith eligibility criteria of beneficiaries of the same?

ANSWER

 

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

The mechanism of distribution / utilization of Zakat funds is defined in Sub-Section (a) (b) & (e) of Section-8 of Sindh Zakat & Ushr Act, 2011. The relevant excerpt is reproduced below:

8. Utilization of Zakat Fund: The moneys in Zakat Fund shall be utilized for the following purposes, namely –

 

(a)  Assistance to the needy, the indigent and the poor particularly orphans and widows, the handicapped and the disabled, eligible to receive Zakat under Shariah for their subsistence or rehabilitation, either directly or indirectly through deeni madaris or educational, vocational or social institutions, public hospitals, charitable institutions and other institution providing health care:

          Provided that the lists of the individuals to be assisted directly and of the institutions through which assistance is to be given from a Zakat Fund shall be prepared and maintained in such form and manner as may be prescribed;

(b) Assistance to the needy persons affected or rendered homeless due to natural calamities like floods and earth quakes and for their rehabilitation;

(e) Any other purpose permitted by Shariah.

According to the definition, ‘mustahiq’ means a person who is eligible to receive Zakat under Shariah and ‘mustahequeen’ shall be construed accordingly. Mustahiq shall be identified through Local Zakat & Ushr Committees and Istehqaq (mustahiq declaration certificate) shall be determined by the Local Zakat & Ushr Committees concerned.

453.     *Mr. Arsalan Taj Hussain:    Will the Minister for Auqaf, Zakat & Ushr be pleased to state:-

 

(a)   Whether there any existing method to verify that the money disbursed as zakat and usher is reaching the needy people and no embezzlement has taken place;

(b)   If answer to (a) above is affirmative, the details thereof?

 

ANSWER

 

MR. FARAZ DERO, MINISTER FOR AUQAF, ZAKAT & USHR:

 

It is mandatory requirement under Section-11 of Sindh Zakat & Ushr Act, 2011, the Auditor General shall conduct annual audit of the Sindh Zakat Fund, District Zakat Fund and Local Zakat Fund including the accounts of a Deducting Agency or an institution receiving Zakat.

Internal Auditors are also regularly conducting audit of District Zakat Fund, Local Zakat Funds and Institutions receiving assistance out of Zakat fund. Both external and internal auditors are also verifying that money disbursed as Zakat is reaching the needy peoples and no embezzlement has been reported sofar.

Zakat funds are disbursed to beneficiaries through cross cheques / order cheques or Auto Teller Machine (ATM) Cards of Sindh Bank Limited in accordance with Sindh Zakat & Ushr Act, 2011 and Sindh Zakat Disbursement Procedure approved by Sindh Zakat Council.
