Provincial Assembly of Sindh in its sitting held on Monday, the 14th April, 2014 has unanimously passed the following Resolution moved by Mr. Mahesh Kumar Malani, MPA:-
“This Assembly condemns the act of Ministry of Health Services and Regulatory Affairs in promulgation of the Ordinance No. III of 2014 to dissolve the entire Council of PMDC. This is against the Constitution of Islamic Republic of Pakistan.
Section 153 (1) states that there shall be a Council of Common Interest, in this Chapter referred to as the Council, to be appointed by the President and Section 154 (1), the Council shall formulate and regulate Policies in relation to matters in Part-II of the Federal Legislative List (and Federal Legislative List (11) Legal, Medical and Professions. (12) Standards in institutions for higher education and research, scientific and Technical Institutions), shall exercise supervision and Control over related Institutions. Whereby all health related issues and regulatory bodies are to be governed by the Council of Common Interest in the light of 18th Amendment.
This Assembly appreciates the decision of Sindh High Court vide Order No. C.P.No. D-1758 of 2014 in restraining the Managing Committee to act as Council of PMDC constituted by Ministry of Regulatory Affairs and uphold the rights as enshrined in the Constitution.”

*06. MS. NUSRAT SEHER ABBASI: Will the Minister for Forest be pleased to state:-
(a) Is it a fact that Arial Seeding of Gorakh hill station is being centenlated;
(b) If answer to (a) above be in the affirmative, when the same will be open for tourists?
ANSWER
MR. GAYAN CHAND, Minister for Forest:
(a) No Arial seeding of Gorakh Hill is being carried out by the Sindh Forest Department. Moveover, any such plan is also not under consideration these days.

*07. MS. NUSRAT SEHER ABBASI: Will the Minister for Forest be pleased to state:-
(a) Is it a fact that thousands trees of gugal were destroyed of injecting poisonous chemical at Thar and contractor mafia damaged the trees in February, 2011 despite imposition of Section-144 at different areas of district Thar;
(b) If answer to (a) above be in the affirmative, the action taken by the Government in this regard?
ANSWER
MR. GAYAN CHAND, Minister for Forest:
(a) It is a fact that several trees of Gugal were destroyed at Thar by injecting poisonous chemical into it by local influential people of the area, the damage occurred to trees in February, 2011 in spite of imposition of Section-144 at different areas of district Thar.
(b) The action was taken on the spot and offenders were caught at the time of offences done at sites during the financial year 2010-11. An amount of Rs. 43,500/- (Rupees forty three thousand and five hundred) only on account of value and compensation were recovered from various offenders as provided under section-68(a) of the Forest Act, 1927.
Looking to the gravity of situation, Forest Department with the help of District Government has taken following actions:-
(a) Imposition of Section-144.
(b) Constitution of vigilance committee at district and taluka levels notified by the District & Session Judge Tharparkar.
(c) Detection of the Gugal Gun extraction by the staff of the Forest Department and submission of regular monthly progress report to Provincial Ombudsman.
(d) Deployment of field staff at sensitive points to check the illegal transportation.
The above mentioned measures have given encouraging results and illicit gum extraction has been reduced to a great extent.
In addition to the above, the efforts of the department in the Nagarparkar areas under the control of Forest Department in Karoonjhar hills are as under:-
(a) Fencing of the selected areas under Gugal plantation over an area of 50.0 acres.
(b) Planting of cuttings over an area of 30.0 acres.
(c) Raising of Gugal saplings and planting over an area of 30.0 acres.
Due to the above mentioned actions, there is a large scale germination of Gugal plants and are under proper protection.
*320. MS. NUSRAT SEHER ABBASI: Will the Minister for Forest be pleased to state:-
(a) Is it a fact that due to shortage of water in Indus river delta area has been deteriorated resulting area of forest is destroyed and water does not reach to kacha area;
(b) If answer to (a) above is affirmative, the steps taken by the government in this regard?
ANSWER
MR. GAYAN CHAND, Minister for Forest:
(a) Yes, it is a fact that delta is under stress and deteriorating due to less receipt of sweet water in Kacha area and the delta. The minimum annual sweet water requirement for sustenance of riverien forest is 0.6 million cusecs, and for survival of Indus delta 10 million acres fact which is not available.
(b) The Irrigation Department being custodian of water affairs shall be appropriate to respond, hence, respected Member may be advised to raise/point the question to Minister for Irrigation, Sindh.
