۱) یہ ایوان مسلح افواج، رینجرز، پولیس اور قانون نافذ کرنے والے دیگر اداروں کے اہلکاروں سےمکمل یکجہتی کا اظہار کرتا ہے۔ اور پاکستان کی بقاء و سلامتی کے لیئے طالبان دہشت گردوں کےخلاف کارروائی میں ان کے ساتھ ہے۔

 

۲) یہ ایوان مساجد، امام بارگاہوں، بزرگان دین کے مزارات، غیر مسلم پاکستانیوں کی عبادت گاہوں، اسکولوں اور بازاروں میں خود کش حملوں اور بم دھماکوں کی شدید مذمت کرتے ہیں اور دہشت گردی کے واقعات کو اسلامی تعلیمات کے منافی قرار دیتے ہیں۔

 

۳) یہ ایوان طالبان دہشت گردوں کے ہاتھوں شہید کئے گئے، مسلح افواج، رینجرز، ایف سی، لیویز اور پولیس کےافسران جوانون کو خراج عقیدت پیش کرتا ہے، شہدا کے لواحقین سے دلی تعزیت اور ہمدردی کا اظہار کرتا ہے اور یقین دلاتا ہے کہ ملک بھر کے عوام ان کے غم میں برابر کے شریک ہیں۔

 

۴) یہ ایوان یہ اعلان کرتا ہے کہ پاکستان ایک آزاد اسلامی ریاست ہے۔ کسی ایک فرقے، فقہہ، عقیدہ  یا مسلک کے ماننے والوں کی جاگیر نہیں، پاکستان میں آباد سکھ، ہندو عیسائی اور دیگر غیرمسلم بھی پاکستان کے مساوی شہری ہیں، ان کا بھی پاکستان پر اتنا ہی حق ہے جتنا اس کے مسلم شہریوں کا پاکستان کے غیر مسلم شہریوں کو اپنی عبادات قائم کرنے اور ان میں مکمل آزادی اور تحفظ کے ساتھ عبادت کرنے کا اتنا ہی حق ہے جتنا پاکستان کے مسلم شہریوں کو مساجد بنانے اور ان میں عبادت کرنے کا حق ہے۔

 

۵) یہ ایوان متفقہ طور پر یہ قرارداد پیش کرتا ہے کہ پاکستان اور طالبان ایک ساتھ نہیں چل سکتے ہیں۔

 

۶) یہ ایوان قانون نافذ کرنے والے اداروں سے پرزور مطالبہ کرتا ہے کہ ریاست کی رٹ چیلنج کرنےوالے طالبان دہشت گردوں سے آہنی ہاتھوں سے نمٹا جائے۔

 

۷) یہ ایوان یہ بھی مطالبہ کرتا ہے کہ قومی سلامتی کے لیئے خطرہ اور ریاست کی رٹ کو چیلنج کرنے والے طالبان دہشت گردوں اورا ن کی حمایت کرنے والی سیاسی، مذہبی جماعتوں کا مکمل سوشل بائیکاٹ کیا جائے۔

*363. DR. SIKANDAR SHORO: Will the Minister for Labour be pleased to state:-

(a)   Date on which tender for construction of 1024 flats in workers welfare board Labour Colony, Hyderabad published in the newspapers with names of newspapers;

(b)   Is it a fact that gross irregularities committed with regard to above which was awarded to favourite contractor;

(c)    If answer to (b) above is affirmative, the details thereof along with the intention of the government to hold enquiry in this regard?

ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

(a)   The date and name of news papers for publication of tender for the work of construction of 1024 flats at Hyderabad is as under

“Daily Jang and Express Tribune on 14-12-2012”

(b)   It is not fact that the above work has not so far been awarded to any contractor.

(c)    Not applicable.

 *400. MS. NAHEED BEGUM: Will the Minister for Labour be pleased to state:-

Year in which flats allotted to the industrial workers during last 5 years along with the criteria for the same and number of the women workers in them?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

It is informed that the Sindh Workers Welfare Board has been allocated 3900 flats to the registered industrial workers in Labour Colony Gulshan-e-Maymar and Northern Bypass, through computerized balloting in the year of 2012. Further informed that in last 5 years the balloting was only made once in 2012.

It is further informed that 266 numbers flats has been allotted to the women industrial workers by this Board in the year of 2012.

The criteria in respect of allotment of these flats are as under:-

 Sindh Workers Welfare Board

Criteria in respect of allotment of flats to the industrial workers at Labour Colony, Gulshan-e-Maymar & Northern Bypass.

1.    These flats/house was allotted on hire/purchase basis.

2.    All the workers of private industrial establishments covered under I.R.O. 2009 and covered by the Factories Act, 1934 as defined under Workers Welfare Ordinance, 1971 how have married and whose family ordinarily resides with them and having 03 years continuous service are eligible to benefit from the scheme. The workers also be registered with EOBI/SESSI and falls under the category of workers.

3.    All applications have been invited through press media.

4.    All the application forms were attested/certified by the employer, C.B.A. & Assistant Director Labour of the concerned area.

5.    All applications were scrutinized by the scrutiny committee constituted by the Board having tripartite representation i.e. employers, workers and government representative.

6.    Allocation was made through ballot is more than the number of available flats/houses.

7.    After the balloting the successful workers were offered for allotment through their management.

8.    The workers were required to submit the following documents.

·         Down Payment through Pay Order or Draft Order.

·         Affidavit regarding the service.

·         Deduction letter duly attested by the employers stating that the worker has authorized the management to deduct the monthly installment from his or her salary and to be submitted to the Sindh Workers Welfare Board on monthly basis.

·         Declaration regarding their marital status and dependents.

9.    The remaining cost will be payable in the monthly installations in the 20 years period.

10. The allotment is not transferable.

11. The allotment order will be liable for cancellation for non-payment of monthly installments for breach of any term of allotment.

 *401. MS. NAHEED BEGUM: Will the Minister for Labour be pleased to state:-

Number of employees registered under EOBI during last two years?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

Employees Old-Age Benefits Institution (EOBI), does not fall under the purview of Labour & Human Resources Department, Government of Sindh, as it is a Federal Entity and not yet been devolved to the Province.

 *538. MS. BILQUEES MUKHTAR: Will the Minister for Labour be pleased to state:-

Punishment fixed against the violation of Child Labour Act, 1991 and number of FIRs lodged in the said case as well as number of accused persons punished?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

Following procedure and punishments have been prescribed under the Employment of Children Act, 1991.

Employment of Children Act, 1991

14. Penalties:-

(1) Whoever employs any child or permits any child to work in contravention of the provisions of section-3 shall be punishable with imprisonment for a term which may extend to one year or with fine which may extend twenty thousand rupees or with both.

(2) Whoever, having been convicted of an offence under Section-3, comments a like offence afterwards, he shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to two years.

(3) Whoever:-

(a) Fails to give notice are required by Section-9; or

(b) Fails to maintain a register as required by Section-11 or make any false entry in any such register; or

(c) Fails to display a notice; or

(d) Fails to comply with or contravenes any provisions of this Act or the rules made there under shall be punishable with simple imprisonment which may extend to one month or with fine which may extend to ten thousand rupees or with both.

 16. Procedure relating to Offences:-

(1) Any person, Police Officer or Inspector may file a complaint of the commission of an offence under this Act is any court of competent jurisdiction.

(2) Every certificate as to the age a child which has been granted by a prescribed medical authority shall, for the purposes of this Act, be conclusive evidence as to the age of the child to whom it relates.

(3) No court inferior to that of a Magistrate of the first class shall try any offence under this Act.

Under the Act the Inspecting Officers of Directorate of Labour, on detecting violation of Employment of Children Act, 1991, lodge complaint with Competent Court of Law and following is updated information regarding complaints filed and punishment awarded.

*539. MS. BILQUEES MUKHTAR: Will the Minister for Labour be pleased to state:-

Amount of grant-in-aid distributed among labourers by Sindh Workers Welfare Board during May, 2011 to May, 2012?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

It is informed that this Board had distributed 1594 cheques in respect of grant-in-aid for marriage of worker’s daughter amounting to Rs. 111.580 (million) @ Rs. 70,000/- each during May, 2011 to May, 2012.

 *544. MS. BILQUEES MUKHTAR: Will the Minister for Labour be pleased to state:-

Number of children freed from labour work and provided basic education with the help of Thardeep NGO up to date?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

The Provincial Child Labour Unit at Head Quarter level who is involved in promoting the mattes related in child Labour and had interacted with the NGO Thardeep.

 The provincial Child Labour Unit furnished the required information which are as below:-

1.    TRDP is working in 6622 villages of four districts of Sindh including Tharparkar, Umerkot, Dadu and Jamshoro.

2.    TRDP phased out some 26634 children from hazardous labour and provided them primary education and vocation skill training.

3.    TRDP has trained 853 government and 113 Non Formal Education (NFE) teachers for the better education of working children.

4.    It has established 113 Non Formal Education Centers for older age working children.

5.    Constructed 189 school buildings.

6.    Provided vocational training to 2193 working children.

7.    Provided live-hood.

8.    Support to their families including Micro Credit, grants etc.

 *609. MS. NUSRAT SEHER ABBASI: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that daily Jang newspaper reported on 12th June, 2013 that an embezzlement of Rs. 24 crores has been made under the head of purchase of medicines in Social Security Department;

(b)   If answer to (a) above be in the affirmative, the reasons thereof along-with the names of persons involved in it?

 ANSWER

SYED QAIM ALI SHAH JILLANI, (Chief Minister) Minister for Labour:

(a)   The tender of medicine 2013-14 was opened on 25th May, 2013 adopting the procedure of “Single Stage Two Envelop” of SPPRA rule but a reply for clarification of clause 1.6 sub- clause-IV of Terms & Conditions raised by a bidder named M/s. Aorta Enterprises could not reach in time as per SPPR Rule. Due to that SPPRA without the tender of medicine 2013-14 and advised to form a Redressal Committee at Annexure, placed on the table of the House.

The Redressal Committee decided for R-Tender with modifying bidding documents.

In the best interest of department as well as for open competition for all, the terms and conditions of tender of medicines were simplified and previous tender was cancelled by worthy Commissioner/Competent Authority SESSI on 27-06-2013 and also ordered for     Re-Tender.

(b)   The Re-tender process is ongoing and scheduled to be opened on 2nd September, 2013.

As mentioned above, the answer of (a) is not in affirmative, the tender of medicine 2013-14 has not been opened and cancelled by the Competent Authority SESSI and the Re-tender is under process.

(a)      No, However the factual position as appended below on the tabulated data reveals that number of factories have increased from 6437 in the year 2008 as against 8353 in the year 2013 up-to June, and similarly the number of workers have also increased from 341409 in the year 2008 to 379307 in 2013 up-to June. The reason apparent increase in number of factories.
