(a)   Is it a fact that construction of houses has been made on forest land in the province;

Yes, Sporadic construction of houses has been made on forest lands. The details are as under:

Afforestation Circle, Hyderabad

1.   Divisional Forest Officer, Afforestation Division, Hyderabad

No construction of houses has been made on forest land under the jurisdiction of Afforestation Division, Hyderabad except some portion of forest land in Deh Railo on the basis of illegal allotment during 1994 and 1995 during reconstruction process of Revenue record. Illegal allottees started construction over forest land.

The department has taken the matter at high level for cancellation of illegal allotment with Revenue department.

2.   Divisional Forest Officer, Range Management Division, Mirpurkhas

Some portion of forest land in Deh Larh, Tebhri and Sarangsar of Chhore Sub-range district Umerkot where houses were constructed by the local people which are under illegal encroachment.

Sindh Forest Department has lodged FIRs against encroachers at P.S Chhore. The Civil Suits of same was filed in the court of Civil Judge/Judicial Magistrate-I, district Umerkot.

The Honourable Court decided the Civil Suits against Forest Department. Hence, appeals against this decision are pending in the office of Prosecutor General Sindh for filing the appeal in the Honourable High Court of Sindh, Hyderabad.

 *4320. MR. MUHAMMAD RASHID KHILJI: Will the Minister for Forest be pleased to state:-

Number of artificial forests exist in the province?

 ANSWER

SYED MURAD ALI SHAH (Chief Minister), Minister for Forest:

Artificial forests are lying under the category of Irrigated Plantations (I.Ps).

In Sindh, 108 I.P forests exist under the administrative control of Sindh Forest Department. List of these forests is attached at Annexure, placed on the Table of the House.

 *4649. MS. HEER SOHO: Will the Minister for Forest be pleased to state:-

(a)      Is it a fact that 20 out of 28 forests are converted into agricultural land by influential persons in taluka Nara;

(b)      Is it also a fact that 1200 acres forest land in Pharhyaro, 200 acres in Topno and 400 acres in Bog is encroached;

(c)      If answer to (a) & (b) above is affirmative, the steps taken by the government in this regard?

 ANSWER

SYED MURAD ALI SHAH (Chief Minister), Minister for Forest:

    (a)      There are 32 reserved forests with total area of 9656.22 acres in taluka Nara District Khairpur. Forest-wise list is Annexure-I, placed on the Table of the House. Out of these 32 reserved forests, only 03 forests contain tree growth of Babul and Eucalyptus over an area of 510 acres as reported by Conservator of Forests, Afforestation Circle, Sukkur. The rest reserved forests in Nara Taluka are devoid of commercially important tree growth since last many decades. However, entire area is in peaceful possession of forest department. The area is undulated, sandy and somewhere become saline having natural vegetation along the Nara canal, therefore not fit Agriculture purpose.

    (b)      Denied. The facts are as under:-

PHARIARO FOREST DISTRICT KHAIRPUR

Total area of Phariaro forest in Deh Phariaro is 1001.21 acres declared as Reserved forest in the year 1958 Annexure-II, placed on the Table of the House. Out of which an area of 694.0 acres being under encroachment on the basis of illegal allotments made by Revenue authorities during the year 1967,1970,1985-86,1993 and 2001. The illegal allottees are in possession of this land since last many decades. As a matter of record, the Forest department had challenged these illegal allotments before various competent forums such as Member Board of Revenue and upto Honourable Supreme Court of Pakistan, but inspite of all efforts, the revenue authorizes have not cancelled the entries. At present the matter of cancellation of entries is pending before the Commissioner Sukkur U/S 164 (Suo Moto) and date of hearing is fixed on 31/08/2016 Annexure-III, placed on the Table of the House. However the Forest Department has lodged (02) FIRs against the encroachers, bearing FIR No.83/2014 and FIR No.129/2015 at P.S Sorah Taluka Nara Annexure-IV & Annexure-V, placed on the Table of the House but still the possession rests with illegal allottees.

          TOPNO FOREST

Total area of Topno forest is 450.4 acres out of which an area of 118.0 acres is under encroachment. The encroachment is old one since last 02 decades. In this context, Forest Department has lodged FIR No.160/2014 against the encroacher named Haji Allah Warayo Rajar S/o Haji Ibrahim Rajar Annexure-VI, placed on the Table of the House.  The case is running in the Honourable Court of Judicial Magisterate Thari Mirwah and is being followed properly.

BOG FOREST

Total area of Bog forest is 306.8 acres out of which an area of 94.0 acres under encroachment. The following FIRs/direct complaints have been lodged by Forest department.

The details of encroachment as well as illegal allotments made by Revenue authorities are already reported to various forums such as Honourable High Court of Sindh under constitutional Petition No. D-4135 of 2012 filled by Rana Faizul Hasan of United Human Rights Commission of Pakistan v/s P.O. Sindh and others as well as District Public Vigilance Committee under the supervision of Honourable District & Sessions Judge Khairpur. However, neither the encroachment has been vacated, nor illegal allotments are cancelled yet by the revenue authorities.

    (c)      Reply of (c) is already given in para (a) & (b).

 *4663. MS. HEER SOHO: Will the Minister for Forest be pleased to state:-

(a)      Is it a fact that hundreds of acres out of 79 thousand acres land of the department is under occupation due to lack of interest of officers of forest division, Shaheed Benazirabad;

(b)      If answer to (a) above is affirmative, number of acres land of Mari, Sukhpur, Nasri and Lakhat forest under occupation?

District/grade-wise number of people appointed in forest department during 2016-2017; Whether the appointment were made on purely merit basis, if so, the details thereof?

 ANSWER

          No person has been appointed in Sindh Forest Department during 2016-17.

 *6433. MR. KAMRAN AKHTAR: Will the Minister for Forest be pleased to state:-

Amount earmarked for afforestation in the province alongwith district-wise detail of new plantation carried-out during 2016-17?

 ANSWER

Total amount earmarked for afforestation in various district of province is Rs.79.166 milion. The details of district-wise plantations carried out during 2016-17 is attached at Annexure-I and Annexure-II.
