157. Will the Minister for Zakat & Ushr be pleased to state:-
District-wise name and number of poor girls provided dowry fund in the province during 2016-17 upto April alongwith criteria followed for the same?
*625. MS. HEER SOHO: Will the Minister for Zakat & Ushr be pleased to state:-
(a) Is it a fact that any fund is received by Sindh from Federation under the head of Zakat;
(b) If answer to (a) above be in the affirmative, the fund received during 2008-2013 upto June?
ANSWER

All Zakat funds are received from Federal Government.

*904. MR. ABDUL HASEEB: Will the Minister for Zakat & Ushr be pleased to state:-
Amount received in head of Ushr during 2008 to 2012?
ANSWER
SYED NASIR HUSSAIN SHAH, Minister for Zakat & Ushr:
No amount has been received in the head of Ushr during 2008 to 2012.
Collection of Ushr stands deferred on the orders of then Governor Sindh vide Secretariat of Governor Sindh’s Letter No.GS/14-87/2000(SO-II)/604 dated.23.02.2000 at Annexure-A, placed on the Table of the House. The reasons for deferment of Ushr was given as under:-
“The Zamindars complained that Ushr was collected in Sindh whereas in other provinces it is not being recovered being the Federal Levy.”
The Secretary (Revenue) Board of Revenue Sindh Hyderabad, informed this Department that Ushr is not being collected since Rabi-2000 onward vide Board of Revenue’s Letter No.DD(E&I)87/04 dated.07.02.2004, Annexure-B, placed on the Table of the House.
Honourable Chief Minister Sindh has approved a summary on 30.09.2016 regarding collection of Ushr by the Board of Revenue Department in accordance with the provisions of Zakat & Ushr Act 2011.
*3506. MS. HEER SOHO: Will the Minister for Zakat & Ushr be pleased to state:-
Amount presently available in provincial Zakat fund along with number of registered beneficiaries presently being paid/not paid “Guzara Allowance”?
ANSWER
SYED NASIR HUSSAIN SHAH, Minister for Zakat & Ushr:
The amount presently available in Provincial Zakat Fund Account No.III maintaining with State Bank of Pakistan is Rs.2,472.00 Million as on 31st January 2016.
The Sindh Zakat Council in its 15th meeting held on 21-08-2014 allocated an amount of Rs.1008.00 Million per annum for disbursement of Guzara Allowance to 84,000 registered beneficiaries at the rate of Rs.1000/- per beneficiary per month. On the basis of list provided by District Zakat Committees an amount of Rs.895.548 Milliom to 74629 beneficiaries of Guzara Allowance have been paid upto 01-02-2016. 4443 beneficiaries have not withdrawn the amount of Guzara Allowance through Sindh Bank ATM Cards. The list of 4928 beneficiaries is yet to be received from the District Zakat Committees.
*3710. MS. NUSRAT SEHER ABBASI: Will the Minister for Zakat & Ushr be pleased to state:-
(a) Is it a fact that various funds have been allocated for vocational training institutes by the department;
(b) If answer to (a) above is affirmative, the details thereof along with areas where the same is utilized?
ANSWER
SYED NASIR HUSSAIN SHAH, Minister for Zakat & Ushr:
No funds have been directly released to any Vocational Training Institute by this department during financial year 2014-15 and 2015-16. However, this department has released in all an amount of Rs.100 Million (Rupees One Hundred Million) to the various District Zakat & Ushr Committees under the head Educational Stipend/Skill Development for utilization. The District Zakat & Ushr Committee concerned is the competent forum to further allocate the funds to Educational/Vocational Training Institutes.
Following District Zakat & Ushr Committees have provided assistance to vocational training institutes during 2014-15 and 2015-16 as per details given below:-

No Officers are posted/working on deputation basis in Zakat & Ushr Department.

Total Zakat Budget amounting to Rs.4.445 Million (Rupees Four Million Four Hundred Forty Five Thousand only) allocated/released to District Zakat & Ushr Committee Shikarpur during the year 2013-14.

ANSWER
SYED NASIR HUSSAIN SHAH, Minister for Zakat & Ushr:
An amount of Rs.866,100/- (Rupees Eight Hundred Sixty Six Thousand One Hundred Only) have been released to District Zakat & Ushr Committee Shikarpur for dowry during the year 2013-14. Zakat funds to District Zakat & Ushr Committees are released under different heads on population basis.

*4956. MS. NUSRAT SEHER ABBASI: Will the Minister for Zakat & Ushr be pleased to state:-
(a) Is it a fact that Administrative Secretary is allowing Mr. Khalid Latif Chairman District Zakat & Ushr Committee Karachi to continue to work without any justification;
(b) If answer to (a) above is affirmative, the reasons thereof and why this illegal appointment is not set aside?
ANSWER
SYED NASIR HUSSAIN SHAH, Minister for Zakat & Ushr:
The details of appointment of Mr. Khalid Latif as Chairman District Zakat & Ushr Committee Karachi and Karachi East are as under:-
i. Nominated as Chairman District Zakat & UShr Committee Karachi w.e.f 23-07-2008 to complete un-expired term of Moulana Irshad-ul-Haq Thanvi upto 10-01-2011 under Zakat & Ushr Ordinance 1980.
ii. Nominated as Chairman District Zakat & Ushr Committee Karachi w.e.f 22-02-2011 under Zakat & Ushr Ordinance 2010 for term of three years upto 21-02-2014.
iii. Six months period extended w.e.f 22-02-2014 under Sindh Zakat & Ushr Act 2011.
iv. Nominated as Chairman District Zakat & Ushr Committee Karachi w.e.f 05-06-2014 for term of three year under Sindh Zakat & Ushr Act 2011 upto 04-06-2017.
KARACHI BIFURCATED INTO FIVE DISTRICTS
v. His nomination/appointment was re-called w.e.f 13-02-2015.
vi. Nominated as Chairman District Zakat & Ushr Committee Karachi East w.e.f 13-02-2015 for a period of three years upto 12-02-2018 under Sindh Zakat & Ushr Act 2011.
Sub-section (6) of Section-14 of Sindh Zakat & Ushr Act 2011 provides as under:-
“The Chairman and members of the District Committee, not being an ex-officio member, shall hold office for a term of three years or during the pleasure of the Council and no Chairman and member shall be eligible for re-appointment after two consecutive terms.”
Opinion of Advocate General Sindh received through Law Department Government of Sindh is as under:-
“I concur with the opinion of M/S Madviwala and Zafar Advocates, that the term of the appointment of District Zakat & Ushr Committees shall be counted from the effective date of appointment under the Sindh Zakat & Ushr Act 2011, instead of appointment under the repealed law if any.”
All the appointments/nominations were made with approval of Sindh Zakat Council. Administrative Secretary has no power to appoint/remove any Chairman District Zakat & Ushr Committee.
