Provincial Assembly of Sindh in its sitting held on Thursday, the 02nd February, 2017 has unanimously passed the following Resolution moved by Mr. Ghulam Murtaza Baloch, MPA/ Special Assistant to Chief Minister, Sindh for katchi Abadies and Spatial Development  and Mr. Nand Kumar, MPA:-

“This Assembly resolves and recommends to the Government of Sindh to approach the Federal Government for grant of 80% subsidy on Electricity bills for agriculture tube wells in Sindh.”.

 *1973. MS. NUSRAT SEHER ABBASI: Will the Minister for Excise & Taxation be pleased to state:-

(a)   List of consultants hired by Excise & Taxation department during January 2009 to December 2013;

(b)   Details of criteria, qualification, experience, previous performance of these consultants along with job description;

(c)    Details of salaries, allowances, TA/DA and other facilities provided by Government to these consultants?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

          The requisite information is at Annexure, placed on the Table of the House.

 *2520. MS. NUSRAT SEHER ABBASI: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Is it a fact that Indian smuggled Pan Parag and Gutka of millions of rupees is brought from Balochistan to Sukkur through different vehicles;

(b)   If answer to (a) above is affirmative, the action taken by the department in this regard?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

       The sale and usage of Pan Parag and Gutka do not fall in the ambit of the Excise, Taxation & Narcotics Control Department. The subject matter is under the jurisdiction of Custom Department and local Police thus Home Department, Government of Sindh is in better position to submit suitable reply.

 *3075. MS. HEER SOHO: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Is it a fact that government has decided to take action against 3893 unregistered motorcycles operating in Hyderabad;

(b)   If answer to (a) above is affirmative, the details thereof?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

(a)      The Excise, Taxation & Narcotics Control Department does not know about any number of unregistered motorcycles operating in Hyderabad as it only authorized to register the vehicles presented for registration. Whereas Traffic Police is authorized to take action against unregistered vehicles.

(b)      However, the Excise, Taxation & Narcotics Control Department, Government of Sindh launch campaign in all over province on quarterly basis against the Motor Vehicle Tax defaulters.

 *3170. MR. KAMRAN AKHTAR: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Is it fact that Rs. 40 m fraud in motor tax collection observed from different branches of National Bank where unspecified number of suspects, E&T staff of Inspector Level involved;

(b)   If so, please give detail of inquiry report, action taken against involved culprits in this crime & future strategy to stop these kinds of offenses?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

(a)      Admitted.

(b)      Subsequently an Inquiry committee was constituted on 05-11-2009 (Annexure-I, placed on the Table of the House).

The said Committee submitted its recommendation on 25-02-2010 (Annexure-II, placed on the Table of the House).

After that, action was taken against 24 officials of Excise & Taxation Department and their services were placed under suspension on 26-04-2010 (Annexure-III, placed on the Table of the House).

In the meanwhile case was also registered in the Enquiries and Anti-corruption Establishment and after examining the matter, 13 officials were cleared vide its letter dated. 19-10-2012 (Annexure-IV, placed on the Table of the House).

In compliance they were reinstated into service in this department on 14-12-2012 (Annexure-V, placed on the Table of the House).

However, the Anti-corruption Establishment had reported that the charges were proved against the following 05 officials only and matter is being prosecuted in the Court of Law vide its letter dated 25-04-2012 (Annexure-VI, placed on the Table of the House).

                     i.        Ali Ahmed Bughio E.T.O/the then Head Cashier Excise & Taxation Department.

                   ii.        Shahid Abid, Jr. Clerk.

                  iii.        Syed Seemab Ahmed, Jr. Clerk.

                  iv.        Amanullah, Jr. Clerk.

                    v.        Fayaz Ahmed Memon, Jr. Clerk.

Regarding future strategy to stop these kinds of offences, it is clarified that proper computerized monitoring system has also introduced to avoid such incidents in future.

 *3241. MS. NAILA MUNIR: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Whether professional tax is collected from employees;

(b)   If answer to (a) above is affirmative, the reasons thereof?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

(a)      Yes, the Professional Tax is being collected from all employees engaged in any employment and assessed to Income Tax in the proceeding financial year @ Rs.150/- per employee/year, as prescribed in 7th Schedule of Sindh Finance Act, 1964.

(b)      Article 163 of the Constitution of Islamic Republic of Pakistan 1973 authorizes Provincial Assembly to levy this tax, as reproduced here under:-

“163. Provincial Taxes in respect Professions, etc. A Provincial Assembly may by Act, impose taxes, not exceeding such limits as may from time to time be fixed by Act of Majlis-e-Shoora (Parliament), on persons engaged in Professions, trade, callings or employments and such Act of the Assembly shall be regarded as imposing a tax on income.”

 *3242. MS. NAILA MUNIR:: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Whether tax is collected from welfare organizations;

(b)   If answer to (a) above is affirmative, the details thereof?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

          Yes, the following 3 taxes are being collected from Welfare Organizations:-

1.    Property tax

2.    Motor Vehicle Tax

3.    Infrastructure Cess.

Further, in the most cases being welfare organizations, they claim exemption under the relevant Act/Rules, which are considered on merits on case to case basis by the competent authority on the request of welfare organization.

However, the following 4 taxes are not leviable on welfare organization:-

1.    Professional Tax

2.    Excise Duty

3.    Entertainment Duty

4.    Cotton Fee.

 *4210. MS. SUMETA AFZAL SYED: Will the Minister for Excise & Taxation be pleased to state:-

(a)   Is it a fact that scheme of computerization of property tax in Sindh approved in 2005 has not been completed;

(b)   If answer to (a) above is affirmative, the reasons thereof and when the same will be completed?

ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

The scheme approved through PDWP on 08-10-2005 for computerization record of Property Tax in Sindh and funds were released in April, 2009 and accordingly the work started. The said scheme completed in 2014, wherein, the data of Property Tax units had been computerized. The Challans for payments of said Tax being generated through computerized system since July 2014.

 *4478. MS. NAILA MUNIR: Will the Minister for Excise & Taxation be pleased to state:-

(a)      Number of registered vehicles (cars) in Karachi, whether unregistered cars also exist in

the city;

(b)      If answer to (a) above is affirmative, action taken against the same?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

There are total 1,242,231 (Twelve lakhs, Forty Two Thousands, Two Hundred, Thirty-One) only Private Vehicles (cars) were registered in Karachi upto the June, 2016.

With regard to unregistered (cars), Traffic Police (Home Department) will be in the better position to reply the said part of question, whereas, the Excise, Taxation & Narcotics Control Department is responsible for registration of vehicles.

 *5748. MR. KHURRAM SHER ZAMAN: Will the Minister for Excise & Taxation be pleased to state:-

(a)      Is it a fact that to further facilitate payment for motor vehicle tax department intends to extend payment facilities with more branches of National Bank of Pakistan throughout Karachi and Sindh;

(b)      If answer to (a) above is affirmative, the details thereof?

 ANSWER

MR. MUKESH KUMAR CHAWLA, Minister for Excise & Taxation:

(a)      Yes.

(b)      Ten (10) Branches of the National Bank of Pakistan are already collecting the Motor Vehicle Tax in Karachi and now in pursuance of departmental efforts the NBP authorize following (5) additional branches of the said Bank for collection of the above Tax:-

1.    Clifton Block-2 Branch.

2.    North Karachi Branch.

3.    Nadir House Branch.

4.    Orangi Township Branch.

5.    Gulshan-e-Hadeed Branch.

Moreover, the department is trying to establish following four (4) Booths for collection of the Tax at the Board of Revenue Facilitation Centers at Karachi:-

1.    Karachi Central, DC Office.

2.    Karachi East, DC Office.

3.    Karachi Malir, AC Airport Office.

4.    Karachi West, DC Office.

One Branch of National Bank of Pakistan and one Booth in the Board of Revenue Facilitation Center are already collecting Motor Vehicle Tax in Hyderabad. Furthermore, the Department also intends to open Booths for collection of Motor Vehicle Tax in the Board of Revenue Facilitation Centers of major districts of Sindh.
