(a) Is it a fact that any fisherman has to obtain permission letter from government for fishing in the sea;
(b) If answer to (a) above is affirmative, the details thereof?
ANSWER
MR. MUHAMMAD ALI MALKANI, Minister for Fisheries:
(a) Yes. The fisherman has to obtain the permission for fishing in waters under jurisdiction of Provincial Government.
(b) Under Section No.3 of Sindh Fisheries Ordinance 1980 (Annexure, place on the Table of the House). The Government is empowered to issue license of fishing.
Procedure for issuance of license is described in Rule 3 and Appendix No.11.3 of Sindh Fisheries rules 1983 notified vide no.5(3)SO(F)/83 dated 31.07.1983.

*2449. HAJI SHAFI MUHAMMAD JAMOT: Will the Minister for Fisheries be pleased to state:-
From which date the Sea Going license is required or enforced. What has happened to the Katpar award which was enforced during the tenure of Shaheed Zulfiqar Ali Bhutto, please advise its status?
ANSWER
MR. MUHAMMAD ALI MALKANI, Minister for Fisheries:
Sindh Fisheries Ordinance 1980 was promulgated on 24 Jan 1980 and by virtue of its section 3(I), the license/lease was required/enforced at once.
The status of Katpar award is given as under:
That the fishing rights of River Indus Thatta used to be auctioned from Jhirik to the Revenue boundaries upto Sea, but during 1972 the then Government allowed free fishing from sea coast to Sajan Wari under Katpar Award, therefore the contracted area of River Indus Thatta was curtailed upto Sajan Wari.
That by virtue of Katpar Award, the fishermen of the Free Zone were supposed to transport their fish catch through sea route and not through the route of contract area (leased area Sajan Wari to Jhirik) to avoid the complications relating to ownership of fish in between lessee and free enjoying fishermen. Whereas in case the fishermen of free zone route their fish from contract area then they should pay batai to the contractor of River Indus Thatta.
After promulgation of Sindh Fisheries Ordinance 1980 and rules made their under in 1983 the Katpar Award dated 10-04-1972 had automatically become infructuous and has got no legal stand.
The Honourable Advisor to Chief Minister for Livestock & Fisheries approved the abolishment of Katpar Award on the 19-08-2004 and fishing rights of the river Indus Thatta including the portion under Katpar Award Viz. River Indus Thatta with new limits Jhirik to sea upto revenue boundaries of district Thatta were put to open auction since then.
After amendment in section 3 of Sindh Fisheries Ordinance 1980 passed by the Provincial Assembly of Sindh on 24-02-2011, the lease system of fishing rights were abolished and license system was kept intact which is still operative in all public waters including water under Katpar Award.

(a) District-wise number of fisheries in the province along with criteria/rule of issuing license;
(b) Type of fish harvested there along with revenue generated by them and the utilization of the same?

The criteria/rule of issuing fishing licenses is given below:
1. The fishing licenses issued to the fishermen as per section 3 of Sindh Fisheries (Amendment) Act 2011.
2. The Fishermen registered under sub-rule 5 of Rules 3 of Sindh Fisheries Rules 1983 on prescribed Fee of Rs.10/- are allowed to apply for the grant of fishing licenses.
3. The registered fishermen make an application on the prescribed form and fee of Rs.01/- under sub-rule 1 of Rule 3 of Sindh Fisheries Rules 1983 for grant of fishing license.
4. The fishing boats are registered on prescribed fee of Rs.50/- as per sub-rule 6 of rule 3 of Sindh Fisheries Rules 1983 prior to making application of license.
5. In inland waters Fishing licenses with nets and boats are issued at Rs.500/- per annum (Category A) and fishing licenses to helper to boat or other fishermen are issued at Rs.100/- (Category B) per annum as per Livestock and Fisheries Department Notification No. SO(Fish)/L&F)/19(23)/07 dated 22-10-2007.
6. The fishing license fee in coastal waters is as under:

(b) Type of fish harvested is given below:
Rahu, Thaili, Morakhi, Gulfam, Dahi, Palla, Gandan, Cirreoh, Seenghari, Khagga, Goonch, Jarko, Singhee, Mundho, Dayo, Bam and Gaangat etc are harvested. Amount of Rs.1,272,145/- was generated as license fee during the year 2013-2014.
The amount generated is deposited into Government treasury as per financial rules of Government of Sindh.

*3719. HAJI SHAFI MUHAMMAD JAMOT: Will the Minister for Fisheries be pleased to state:-
(a) Is it a fact that Fishing Harbour Authority is restricted to grant permission of fishing in their own jurisdiction;
(b) If answer to (a) above is affirmative, whether they can grant permission outside their limits?
ANSWER
MR. MUHAMMAD ALI MALKANI, Minister for Fisheries:
(a) Yes.
(b) Karachi Fisheries Harbour Authority (KFHA) is granting permission to fishing boats plying from Karachi Fish Harbour according to Karachi Fisheries Harbour Authrity Ordinance 1984 and Karachi Fisheries Harbour (Control and Management) Regulation 1991.
Administrative department has delegated the powers of Sindh Fisheries Ordinance, 1980 to KFHA vide notification No. 5(9) SO(F)/84 dated:23rd December, 1984.
*3721. HAJI SHAFI MUHAMMAD JAMOT: Will the Minister for Fisheries be pleased to state:-
(a) After 18th amendment, whether fishing is a subject of Provincial Government or Federal Government;
(b) Whether port clearance is required on fishing boats fishing in Pakistani territory/coastal areas or it is required on cargo boats only as central government department of customs demand port clearance from each fishing boat?
ANSWER
MR. MUHAMMAD ALI MALKANI, Minister for Fisheries:
(a) Fishing was not included in concurrent list. The inland fishing is subject of province however Marine Fisheries is divided between province and Federation.
According to the Fishing Policy vide S.R.O.682(I)/2009 dated: 15th July 2009 issued by Federal Government, marine area from the coastline has been divided into three zones.
i. Zone-I From coast line upto 12 nautical miles (NM) reserved for traditional small scale fishermen, no deep sea boats are allowed.
ii. Zone-II (Buffer) between 12 to 20 NM, to provide exclusive access to small scale local fishermen, there is no restriction for local fishing boats to operate in this zone, no deep sea boats are allowed in this zone.
iii. Zone-III Between 20-200 NM reserved for medium/large size deep sea fishing boats. Zone-I is pertains to Provincial Government & Zone-II is a buffer zone in which Fishing by deep sea boats/Trawlers, whereas in Zone-III Federal Government is competent to make policy etc.
(b) According to the Custom Act 1969 and rules of Central Board of Revenue, Port Clearance is required on each fishing boats in Pakistan territory/coastal areas for departing and returning fishing craft to the Karachi Fish Harbour.
