*719. MS. HEER SOHO: Will the Minister for Law be pleased to state:-
Total number of staff presently working for criminal prosecution alongwith the number of staff required?
ANSWER

The detailed reply of the question has been received from Criminal Prosecution Service Wing, Law department, which is at Annexure, placed on the Table of the House.
*2214.MR. KHURRAM SHER ZAMAN: Will the Minister for Law be pleased to state:-
(a) Is it a fact that there are some legal complications in family laws creating difficulties for parents to meet and take their children;
(b) If answer to (a) above is affirmative, the details thereof?
ANSWER
SYED MURAD ALI SHAH, (Chief Minister) Minister for Law:
There are no legal impediments or complication in the Guardian and Wards Act, 1890 which may create difficulties for parents to meet and take their children, nor is any provision of the statute hampering such process. However, the difficulties, at times, are created by the parties to the litigation for satisfying their ego. Nevertheless, it is recommended that the family courts be established in separate buildings containing all the facilities for child-parent meeting in conducive environment. Separate budgetary allocation in this behalf be made to detach the family courts from regular courts.

(a) Is it a fact that there are separate courts and judges for family law;
(b) If answer to (a) above is affirmative, the district-wise details thereof?
ANSWER
SYED MURAD ALI SHAH, (Chief Minister) Minister for Law:
There are separate judicial officers for the family courts. However, owing to non-provision of separate space and infrastructure, such courts are functioning, across the province, in he same courts houses which are meant for District & Sessions Courts or Civil Courts. The district-wise details of family courts in Sindh are as under:-

*3018. MR. KAMRAN AKHTAR: Will the Minister for Law be pleased to state:-
(a) Is it a fact that government intends to appoint Parliamentary Secretaries;
(b) If answer to (a) above is affirmative, terms and conditions of the same?
ANSWER
SYED MURAD ALI SHAH, (Chief Minister) Minister for Law:
That it is exclusive purview of the Hon’ble Chief Minister to appoint Parliamentary Secretary by general or special order to deal with such parliamentary affairs concerning the department, vide rule 7-A of the Sindh Government Rules of Business, 1986 which reads as under:-
“7-A. A Parliamentary Secretary for department shall subject to any general or special order, issued by the Chief Minister in this behalf, deal with such Parliamentary affairs concerning the department as may be entrusted to him by the Minister and perform such public relations and functions as may be entrusted to him by Minister:
Provided that a Parliamentary Secretary shall not be required to undertake any function which may entail any interference in the internal working or administration of a department, attached department or a regional office.”
From the above provisions, it appears that the Parliamentary Secretary is appointed by general or special order of the Chief Minister and on receipt such order, the terms and conditions of the Parliamentary Secretaries are dealt with by the Law department, under the Sindh Parliamentary Secretaries (Salaries, Allowances and Privileges) Act, 1974.

Bench-wise number of cases lying pending with High Court and sub-ordinate Courts?
ANSWER
SYED MURAD ALI SHAH, (Chief Minister) Minister for Law:
Since Hon’ble Chief Justice assign the work to the Hon’ble Judges on the basis of Roster sitting, which are always different, therefore, there is no bench-wise number of cases pending in the High Court, however, court-wise data of sub-ordinate judiciary is at Annexure, placed on the Table of the House.
*3617. MS. HEER SOHO: Will the Minister for Law be pleased to state:-
Number of family cases registered in High Court and sub-ordinate courts during 2010-2013 and out of them number of cases heard and disposed off?
ANSWER

Family cases are not filed in the Hon’ble High Court being an Appellate Court but the same are filed in the sub-ordinate judiciary, therefore, data of such cases from sub-ordinate judiciary of Sindh are as under:-
