Summary of Proceedings

Provincial Assembly of Sindh in its sitting held on Monday, the 14th March, 2011 has unanimously passed the following Resolution moved by Mr. Saleem Khursheed Khokhar, MPA and Mr. Pitanbar Sewani, MPA:-

 

This Assembly resolves and recommends to the Federal Government to recommend the name of Shaheed-e-Haq Shahbaz Bhatti, Ex-Federal Minister for a Nobel Prize. He worked for the equality of rights for minorities in Pakistan and promoted religious harmony and democracy in Pakistan and promoted the vision of the Father of the Nation, Quaid-e-Azam Muhammad Ali Jinnah, Shaheed Zulfiqar Ali Bhutto and Shaheed Mohtarma Benazir Bhutto Sahiba.

               This Assembly is deeply affected by the devastating earthquake and Tsunami that caused mass scale destruction in Japan extends its deepest sympathies to the people of Japan who are currently experiencing the gravest catastrophe since World War-II; expresses its condolences to the families of the thousands who lost their lives and to the Japanese Nation, understands the overwhelming calamity currently faced by Japan, having ourselves experienced the catastrophic earthquake of 2005, appreciates the support extended to japan by the International Community including the Honourable President of Pakistan and assures the People of Japan of the continued utmost support of the Pakistani Nation during this time of their acute crisis.

*3937. MS. HEER ISMAIL SOHO: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that children have been put on forced labour at 17 places in district Sukkur;

(b)   If answer to (a) above is in the affirmative, names of said places alongwith number of the children?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      No forced Labour has been reported in the area by the Officers of Labour Directorate Sukkur. Labour Officers always visit and inspect in the area in accordance to Labour Laws.

(b)      The answer to question (a) is not in affirmative and there are no reports of child Labour in the area.

 

 

*3968. MS. NUSRAT SEHER ABBASI: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that about more than 20 brick kilns exist in the Marriage Lodge “Kloi”, “Wingo” and in the adjacent areas where men, women and children are being forcibly put on Labour;

(b)   If answer to (a) above is in affirmative, action taken by the Government in this regard?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      There are total 31 brick kilns factories registered in Marriage Lodge, “Kloi”, “Wingo” and adjacent areas of district Tharparkar. No women and children are working in the given industries and no forced Labour has been reported by the area officers. The total number of workers working in all these factories is 443.

(b)      Since no child Labour and forced Labour is reported, therefore no action on the part of Government may be required in the matter.

Number of Industrial workers in which the sewing machines have been distributed along with number of sewing machines distributed?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

6300 sewing machines distribution among 6300 workers during the year 2008. Due to non-availability of funds since last two years no machine was distribution among workers, District-wise details of distributed machines among workers during the year 2008 is given below:-

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      Yes, it is a fact that the death grant to the widows/legal heirs of expired workers was given by the Sindh Welfares Board during the year 2009.

*4105. MR. ALEEM-UR-REHMAN: Will the Minister for Labour be pleased to state:-

District-wise number of Labour Inspectors appointed during the tenure of present government?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

One Labour Inspector namely Mr. Noor Nabi Memon, has been appointed during the present Government tenure and he has been posted in Karachi. His appointment was against the deceased quota, since has father late Mr. Shabbir Ahmed Memon, who was posted as Labour Officer in the Directorate of Labour, had expired on 08-09-2009, while he was in service. Approval of this appointment has been made by the Competent Authority.

 

 

*4163. MS. HEER ISMAIL SOHO: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that labour and haries are being put to forced labour at different places;

(b)   If answer to (a) above is in affirmative, the legal steps taken or intended to be taken by the Government in this regard?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      No case of forced Labour as to relating Industrial/Commercial establishments in Sindh Province reported from the Regional office Hyderabad or Divisional offices in Karachi. As to the issue of Haries on Forced Labour, the issue not relating and neither within the purview of this Department.

*4482. MS. HEER ISMAIL SOHO: Will the Minister for Labour be pleased to state:-

(a)   Number of bangles factories exist in the province alongwith number of workers working in there;

(b)   Is it a fact that a large number of women are also working in above factories;

(c)    If answer to (b) is in the affirmative, the details thereof?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      56 Glass Bangles Factories registered under the Factories Act, 1934 and 1048 workers are working in these Factories.

(b)      Women Workers are also working in above Factories but not in large number.

(c)      That about 168 Women Workers are working in Bangles Factories.

 

 

*4483. MS. HEER ISMAIL SOHO: Will the Minister for Labour be pleased to state:-

(a)   Number of Sugar Mills exist in the province alongwith number of employees/labours working there;

(b)   Is it a fact that above employees/labours are registered with SESSI;

(c)    If answer to (b) above is in affirmative, the details thereof and is in negative, the reasons thereof?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      There are 32 Sugar Mills in the Province and 10,340 workers are employed in these Sugar Mills.

(b)      Yes, employees/labours are registered with SESSI.

(c)      Answer to (a) is in affirmative. The details are at Annexure, placed on the table of the House.

 

 

*4484. MS. HEER ISMAIL SOHO: Will the Minister for Labour be pleased to state:-

District-wise amount of bid for excise duty given and approved on various minerals in Sindh during 2009-10?

The matter is sub-Judice. The Case is pending in the Hon’ble High Court and has already given stay in Suit No. 1705/2008 filed by Mr. Shewak Babu V/S Government of Sindh.

 

 

*4507. MR. ARIF MUSTAFA JATOI: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that after abolition of the concurrent list in the constitution workers health insurance, pensions and old age benefits are now Provincial subjects;

(b)   If answer to (a) above is in affirmative, the steps taken to implement on it?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      It is a fact that after abolition of the concurrent list in the constitution of Pakistan Health Insurance, pensions & Old-age benefits is now a provincial subject. But it has still not been devolved to the provinces. Its devolution to the provinces is to take place before 30th June, 2011 as per 18th Amendment.

(b)      The answer to (a) above in negative.

 

 

*4508. MR. ARIF MUSTAFA JATOI: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that after abolition of the concurrent list in the constitution on un-employment insurance is now a Provincial subject;

(b)   If answer to (a) above is in affirmative, the steps taken to implement on it?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      Un-employment Insurance was subject of concurrent list. Concurrent list has been abolished but it has still not been devolved to provinces. Therefore it is not dealt-with by Provincial Government or any its subordinate attached department. Under Sindh Employees Social Security Institution’s Social Security Scheme besides Comprehensive medical coverage to the secured persons and their dependents including parents, cash benefits like Sickness Benefit, Injury Benefit, Maternity Benefit, Death Grant, Iddat Benefit, Disablement Gratuity, Disablement Pension and Survivors pension are also Admissible to the Secured persons and their dependents as per their entitlement.

*4514. MR. ARIF MUSTAFA JATOI: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that after abolition of the concurrent list in the constitution regulation of trade unions is now a Provincial subject;

(b)   If answer to (a) above be in the affirmative, the steps department is taking to support and regulate trade unions?

 

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      It is fact that after abolition of the concurrent list in the constitution, regulation of trade unions is now a provincial subject. However, since the exiting Law dealing with all trade union related matters, under the title of Industrial Relations (Revival & Amendment) Act, 2010” includes within it Federal related subject such as NIRC, therefore efforts on fast track basis are being made to entirely modify/introduce a completely Provincial Law on the Industrial Relation. Though the Provincial Sindh Assembly in its Session held on 25-06-2010, had approved some amendments given title of law of 2008, as Industrial Relations (Revival & Amendment) Act, 2010 but the provisions relating to Federal subject i.e. NIRC are still part of it.

(b)      The Department has already taken serious efforts and working hardly to modify/introduce a completely provincial law on the IR. In order to work and draft a consensus document on this most important labour law, a committee consisting of the representative of important trade unions/workers federations, representatives of employers associations and officers of this Department, has already been constituted and notified and it is working hardly to finalize this important document as a completely Provincial Law. There are some problems due to the preoccupation and other commitments of committee members but hopefully issue will be finalized in least possible time, for its onward submission for further necessary action.
