1.Resolution No. 21, given notice of by Haji Munawar Ali Abbasi, MPA regarding immediately stop the demolishing of ancient villages and Katchi Abadies of Karachi, which aim to deprive the people of Sindh from the right of existence and would promote     the builder mafia.

2.Resolution No. 157, given notice of by Mr. Muhammad Shahryar Khan Mahar, MPA regarding ensuring the availability of seed for Rice for all kinds of Rice grain in our province to all the farmers for the coming peddy season.

3.Resolution No. 56, given notice of by Mr. Mazahir Amir Khan, MPA regarding Provincial Government should approach the Federal Government to issue directive to all the telephone service providers to stop forthwith these illegal charges and refund the amount of sales tax collected earlier.

*406. MR. NADEEM AHMED BHUTTO: Will the Minister for Labour be pleased to state:-

(a)   Is it a fact that many employees of Faran Sugar Mill, Taluka Shaikh Bhirkyo, Tando Muhammad Khan were illegally terminated on 13th April, 2003 by the management;

(b)   If answer to (a) above is in affirmative, details thereof alongwith names of removed employees;

(c)    Is it a fact that Government have taken or intends to take action for re-instatement of the employees;

(d)   If answer to (c) above is in affirmative, time by when they will be re-instated?

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      M/s Faran Sugar Mills Ltd. Shaikh Bhirkyo terminated the services of 436 workers of the mills in the year, 2003 after obtaining their voluntary resignations under Golden Hand shake scheme.

The Directorate of Labour took cognizance of the above and filed a complaint No. 01 of 2004 under SO-II-A of West Pakistan Industrial & Commercial Establishments (Standing Orders) Ordinance, 1968 before the Sindh Labour Court No VI, Hyderabad.

The Honourable Sindh Labour Court No. VI, Hyderabad held in the above case that there was no forcible termination of workers and it was resignation voluntarily tendered by the workers with their own free will and after receiving handsome amount. Hence no violation of Standing Orders II-A, therefore Sindh Labour Court No. VI, Hyderabad dismissed the complaint. Copy of order dated 21-05-2004 at Annexure, placed on the table of the House.

(b)      The management has been requested to furnish the names of the removed employees which is still waited.

(c)      The Government had taken the initiative and a complaint was filed against the M/s. Faran Sugar Mills Limited, Shaikh Bhirkyo as narrated above and as such there is no further action to be taken by the Government.

(d)      As the answer to (c) is not affirmative and as such need no reply.

(a)   Is it a fact that the employees working in industries are given privilege of compulsory insurance in case of natural death, injury or disability;

(b)   If answer to (a) above is in affirmative, maximum/minimum payable amount of compensation?

ANSWER

MR. AMIR NAWAB, Minister for Labour:

(a)      Yes, This is a fact.

(b)      Maximum Rs. 200,000/- in case of death or 100% disability Minimum according to the nature of disability suffered by he worker and assessed by the Medical Officer as provided in schedule-I & Schedule-IV under the workmen’s compensation Act, 1923. Copies are at Annexure, Placed on the table of the House.

 

 

*613. SYEDA MARVI RASHDI: Will the Minister for Labour be pleased to state:-

Whether it is fact that industries are run under the west Pakistan Industrial & Commercial Employment (Standing Orders) Ordinance 1968 in the province?

ANSWER

MR. AMIR NAWAB, Minister for Labour:

Yes, the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance 1968 is applicable on industries in the Province.

The relevant section of Ordinance is reproduced as under:

Section (a) Every Industrial & Commercial Establishment wherein 20 or more workmen are employed directly or though any other person or were so employed any day during the preceding twelve months.

Section-2 (1) of the Ordinance defined Industrial Establishment means:

(i)           An Industrial Establishment as defined in clause (ii) of Section-2 of the Payment of Wages Act, 1963 (IV of 1936) or

(ii)          A factory as defined in clause (J) of the Factories Act, 1934 (XXV of 1934) or

(iii)        A railway as defined in clause-4 of section-3 of the Railway Act 1890 (IX of 1890) or

(iv)         The establishment of Contractor who directly or indirectly employs workmen in connection with the execution of contract to which he is party.

(v)          The establishment of a person who directly of indirectly employs workmen in connection with any construction industry.

 

The rest of Industries are run under the Factories Act, 1934 where 10 or more workmen are employed.

MR. AMIR NAWAB, Minister for Labour:

At present there is no any Educational institute functioning in District Mirpurkhas as on 01-08-2008. However two School, (both up-to secondary level) for Boys and Girls, are under construction in District Mirpurkhas and are expected to be functional from next academic year.

(a)   Whether any Hospitals/Dispensaries established by SESSI is working for the Labourers in District Mirpurkhas;

 ANSWER

MR. AMIR NAWAB, Minister for Labour:

Yes, Sindh Employees Social Security Institution (SESSI) has a Dispensary at Lunda Bazar Mirpurkhas where requisite staff is available. It caters to the need of 500 secured workers and consequently atleast 2000 dependents. It remain open from 8.00 a.m to 2.00 p.m.

 

 

*932. MS. SHAMIM ARA PANHWAR: Will the Minister for Labour be pleased to state:-

(a)   Whether the Industrial Women Labourers were provided “Jahez Fund” by the Sindh Working Welfare Board during last three year in District Mirpurkhas;

(b)   If answer to (a) above in affirmative, the details thereof?

 ANSWER

MR. AMIR NAWAB, Minister for Labour:

The Sindh Workers Welfare Board has been providing Jahez Fund through marriage grant scheme to the Industrial Women Labourers in District Mirpurkhas. The marriage grant was not distributed during the year 2004-05 .However marriage grant distributed during last two years are given as under :-

(a)      There are Eleven Vocational Training Centers/ Youth Vocational Centers established in Sindh, including Youth Vocational Centere, Sujawal at District Thatta, at Annexure-I, placed on the table of the House.

(b)      The statement showing the number of sanctioned Instructors and enrolment of students in vocational centers with their/ faculty at Annexure-II, placed on the table of the House.

(c)      There are four sanctioned posts of Instructors in BPS-16/17 at Youth Vocational Center Sujawal having faculty of Auto-Mechanic, Electrician and Steno/Typing.
